Choosing applicable law upon entering into marriage
Upon entering into marriage, the two spouses may choose the applicable law to their matrimonial regime and, depending on that, to decide on drawing a matrimonial convention according to their patrimonial interests.
When spouses have different citizenships, are due to establish their common domicile after the signing of the marriage acts in a different country, or they do not have a common domicile, it is advisable that they choose an applicable law to their marriage.
Each time spouses change their common domicile, their matrimonial patrimony becomes subject to a new law, that is, the law of the country in which they have just established residence.
More often than not, people ignore this fact, as they do the fact that there are way to protect them from such unwanted, unanticipated changes.
All these protections are provided to them by signing a matrimonial convention and choosing from the very beginning an applicable law for their marriage , be it the Romanian law or the law of another state whith which the spouses have a citizenship or residence-related connection.Many patrimonial complications can thus be avoided.
